This document, the Terms and Conditions of Service (the "Terms"), governs the relationship between tryVPN ("We", "Us", the "Provider"), providing access to the use of the tryVPN service (the "Service"), and You ("You", the “User") in regards to the use of the Service and to providing the User with access to the Service on the terms outlined below.
The Service, provided by tryVPN, includes the www.tryvpn.com website (the "Website"), tryVPN mobile applications ("Mobile applications"), tryVPN computer software ("Software") and all services, including VPN service, provided through the Website, Software and Mobile applications.

These Terms constitute a legally binding agreement (the "Agreement") between You (the User) and the Provider. Use of the Service implies the full consent of the User to the terms and conditions set forth in this Agreement. By registering on the Website and creating an account (the "Account") in order to use the Service, You accept this Agreement and agree to be bound by all the terms and conditions set forth in these Terms. If You do not agree to these Terms, in whole or in part, You may refuse to use the Service.
The User agrees to follow these Terms in each case of use of the Service, including the use of the Website, Software and Mobile applications.
The Service is provided only to persons who are at least 18 years old. If You are under the age of 18 years, you may use the Service only with the consent and permission of your parents and/or your legal guardians. By accepting this Agreement, the User confirms that his/her has reached the full 18 years or has the consent of his/her parents and/or guardians to use the Service.
The User may not transfer their rights and obligations under this Agreement to third parties.
The Provider reserves the right to modify, make changes and/or additions to these Terms at any time without notice to Users. The updated version of these Terms shall become effective upon publication on the Website. The Provider may, at its sole discretion, notify Users by e-mail ("E-mail"), provided by Users at the time of registration, of any changes made to these Terms.
The User is solely responsible for informing himself/herself about the changes made to these Terms and undertakes to regularly check the Website for such changes. The use of the Service by the User after such modifications implies full acceptance of the User with the updated version of these Terms.
To use the Service, the User must make a payment by one of the available payment methods. The Service is provided to the User as long as there are enough funds on the User's account to pay for the Service plan chosen by the User. If the funds on the User's account are insufficient, the Provider reserves the right to suspend the User's access to the Service.
The Provider reserves the right to make changes to the price of the Service at its sole discretion without prior notice. These changes in price shall be reflected on the Website and will take effect from the date of publication on the Website, unless otherwise specified. Recalculation occurs automatically. The User agrees to regularly check the Website for changes in the current cost of the Service.
The Provider reserves the right to suspend the User's access to the Service and/or completely terminate the User's Account without prior notice if the Provider finds that the payment information provided is inaccurate, incomplete and/or false, intentionally or unintentionally.
Since we are confident in the quality of our Service, we provide Users with a free 14-day period of use of the Service without restrictions and with full functionality. After this free period, the use of the Service becomes paid.
In the future, the Provider may introduce a refund procedure, which will be reflected in the relevant updated version of these Terms.
This Agreement assumes compliance with the laws of the regions, states and entities in the territory of which the User accesses the Service. By using the Service, the User agrees to be fully responsible for compliance with the rules and regulations established by the legislation, applicable to the geographical location of the User, with each use of the Service.
The User is solely responsible for the security and safety of information relating to the User's Account. In the event that such information is made available to third parties due to the User’s fault, the Provider shall not be liable for that and has the right to suspend access and/or terminate the compromised Account at its discretion.
When using the Service, the User agrees to comply with the rules, regulations and provisions set forth in these Terms and local laws. If the User violates such rules, the Provider is entitled to unilaterally, without notice to terminate the Agreement and/or to completely prevent User access to the Service with the termination of the User’s Account. The Provider also has the right to terminate and close all Accounts created by bots and/or other means of automatic registration.
When using the Service, the User agrees not to:
- Send unsolicited advertising and other unsolicited messages (i.e. “spam”);
- Send, post, download, transmit any illegal content, including but not limited to pornography, child pornography;
- Carry out any activity for the purpose of harassment, insult, harm, defamation, slander, humiliation, intimidation or discrimination on grounds of, but not limited to, gender, sexual orientation, religion, ethnicity, race, age, national origin, disability;
- Attempt to connect or gain access to computers, networks, or other devices without proper authorization (i.e. “hacking”);
- Send, post, download, transmit any materials that are subject to copyright and/or other rights without proper permission;
- Promote any illegal activity, assist in and/or support such activities of others by encouraging, provoking, and/or providing instructional information;
- Carry out any other activity contrary to the current legislation.
One Account provides a license to use the Service for an unlimited number of simultaneous connections, which can be used on an unlimited number of devices. Each connection must be made subject to the provisions of this Agreement.
All Mobile applications and Software of the Provider are licensed and are the intellectual property of the Provider, including the Website. The User is prohibited from attempting to hack, reverse engineer, decompile, decode, and modify the Software, Mobile applications and the Website of the Provider, as is also prohibited to take any other actions that violate intellectual property rights, this Agreement or applicable law.
The Provider may provide the User, including by publishing on the Website, links to third-party websites, in order to create information support for Users in areas related to the service provided. The Provider is not affiliated in any way with third-party websites, the use of which may be subject to other terms and privacy policies. The Provider assumes no responsibility for the materials provided on third-party websites, as well as no responsibility for the results of the User's use of third-party websites.
We make due efforts in our opinion to ensure the best performance of the Service, however it must be noted that the Service is provided "as is". The Provider does not guarantee complete security of the User's data and is not responsible in case of access to the User's data by third parties as a result of the User’s use of the Service. Also, the Provider does not guarantee the accuracy of any materials or information obtained by the User as a result of using the Service.
The operation of the Service depends on many factors over which the Provider has no control. The Provider shall not be liable for any failures or delays in the operation of the Service, for damage or loss of data, for non-compliance of the received materials with the User's expectations or for other errors in the operation of the Service. The Provider does not control and is not responsible for any materials, data or products obtained by the User as a result of using the Service.
Not all servers allow the use of p2p. The use of p2p may be permitted or prohibited on servers at the discretion of those parties who manage these servers. We mark those servers that allow the use of p2p and recommend using them. However, the Provider does not guarantee the relevance of this information and is not responsible if the information regarding servers marked as allowing p2p is found to be out of date.
The Provider may, at its discretion, carry out preventive, repair work in order to improve the level of Service. Such works may cause unavailability of the Service. The Provider shall not be responsible for the unavailability of the Service as a result of such works.
The User under this Agreement is aware of all possible risks associated with the use of the Service and is fully responsible for the results of the use of the Service, including, but not limited to possible: damage to the User's business, damage to the User's devices, other material and/or intangible losses of the User resulting from the use of the Service.
The User agrees to indemnify the Provider, including its management, officers, employees, agents and other persons affiliated with the Provider, from claims, judgments, liabilities, damages, compensation, costs and other claims, including attorneys' fees, as a result of the User's use of the Service, or any other actions or omissions of the User under this Agreement.
